For the amount you paid, that is 100% unacceptable. You can get a full refund from ebay's Buyer Protection policy. I would ask for a partial refund from the seller due to damage. If that doesn't work, file a complaint with ebay & paypal. Get your money back, and send the art back to the seller. Try again another day and get one that isn't damaged.

Don't settle for damaged art! it's the seller's job to insure that it gets to your door okay. They have to insure it (according to ebay), and if they don't- it's the seller's loss.

Frustrating, this happened just a few weeks ago and now with my first Simonson.

Ryan- it happens to us all. I now make a habit whenever I get an ebay auction (or buy art) to specifically write a note saying "please pack in a sturdy package, as the post office has been a bit rough to artwork lately".

What that really means is "don't be an idiot and send that in a single flattened box. If you do, and it get's damaged, I will demand my money back."

Thankfully, ebay's new policies favor the buyer when dealing with damaged items. Great for buyers, bad for sellers.

In all seriousness, I agree with Dave.  Start with asking for a reasonable amount of money back and let him know if he doesn't agree to it, he'll have to refund the whole thing and you return the art.  *

*This assumes you are willing to take a refund and be happy and also assumes you'd be willing to send the art back!  It's really up to how you personally feel!  Sorry that happened to you!

That is one of the nicest sketches I have seen by Walt Simonson in a long time.  If it can be brought back to a decent condition, I would ask for a partial refund also.  It is a shame the seller would do this to save a few bucks on shipping costs.

I read Daredevil #47 "Brother, Take My Hand!" for the first time in Son of
Origins when I was about 7 years old. I really loved that story when I was a
kid, DD wasn't fighting any super villain but it really stuck with me thru
the years.
It is one of my favorite stories, been looking for the interiors but none
have ever surfaced so I am thrilled to own the cover.
It is different than the published cover, the logo was made large and
stated so DD's feet had to be painted over. At some time the stat was
removed and here you see the original art.
This is very fortuitous as Stan 'the man" Lee will be at my LCS in October
so I will get him to sign it before it gets framed and will be hung in my
den.
