You know, this might be the moment when JB contacts S+S and asks for
permission to use Superboy in a comics series...could that happen? ********************************************* I doubt it. (but IANAL)
Although it's fun to think about, the fact is that Superboy is clearly a derivative work of Superman. The legal system would have to figure out whether the non-DC Superboy would be allowed to use the S shield, the costume, the spit-curl, kryptonite, etc.
And there's no legal confusion over the rights to Lex Luthor or the Legion, without whom what's the point?
It does seem like Marvel might be able to use the confusion to repeat their Captain Marvel name grab, though. Assuming they would want to try to nab the name Superboy.

Perhaps Time-Warner/DC will step up and do what needs to be done to
keep Superboy.

Well, it's entirely possible to keep the basics of the Superman origin only using Superboy as a young Superman, redefining his hero contacts and villains as necessary. Surely there's more than enough character ostensibly in the public domain to make Superboy's life interesting, without resorting to Luthor or the Legion.
I'm thinking about what Stan Lee and Jack Kirby did with the Silver Surfer in 1978, in the graphic novel they produced. The basics of the Surfer was kept, the extraneous stuff with the FF and Doom and the Defenders was subjugated, and the story still worked as a Surfer tale complete with everything you'd expect. This is how Superboy could be done...even Superboy in the future, since it isn't absolute essential that Superboy stay in direct contact with the Legion. You could make all of that stuff vague, turn Superboy into an honorary member and send him out with created-for-the-series "new" Legionnaires, like Atomic Lad and Pillowy Bosom Girl, on adventures.

DiDio said Connor was "permanently temporarily dead" yesterday at one of
the DC panels at SDCC. Take that for what you will.

I think DiDio was making a joke that Connor would stay dead until the legal issues got solved about Superboy. DC wins, Connor is back as Superboy. DC loses, Connor stays dead.

I'm not saying it was the right move in killing Connor. Just par for the course in the current super-hero climate. Kill a hero, big sales. Bring back the hero, big sales. Tell interesting stories on a monthly basis with said hero, okay sales.

Well, they were going to kill Nightwing....until Johns changed Didio's mind, or Didio realized that the fans had figured it out and then he said "Hey, how about we kill Superboy instead?"

I liked how Karl Kesel wrote the clone Superboy--especially that Hypertime
story. Geoff Johns did a good job with him, too.
